If an image has been registered with the Copyright Office, a copyright owner may elect to recover statutory damages under Section 504 even if actual damages (such as lost profits) can‚t be proved. Statutory damages are set by law, and the copyright owner of a registered image can elect to choose statutory damages or actual damages for infringement. If you can prove the infringement was committed willfully, the court has the discretion to increase the damages from $30k up to $150,000 per work.
On the other hand, if the infringer can prove he was not aware and had no reason to believe the act was an infringement, the court may reduce the award down to $200.
A copyright notice (especially a watermark, but also embedded metadata) on an image makes it hard for someone to claim that they "didn't know" the work was copyrighted. Intentional,
unauthorized removal of a watermark may also be a violation of the DMCA. The legal value of watermarks by copyright holders (and end users) is often under-appreciated. It's hard to claim
that a watermark was not noted and removed intentionally.
